OSHA Porta Potty Requirements for Construction Sites

OSHA 29 CFR 1926.51(c) requires toilets on every construction site: 1 for 20 or fewer workers, 1 seat and 1 urinal per 40 workers for 20 or more, and 1 per 50 for 200 or more. Washing facilities are required under 1926.51(f) where workers handle harmful materials.

What does OSHA Table D-1 say?

OSHA Table D-1 lists the minimum toilet facilities by number of employees. 20 or fewer employees need 1 toilet. 20 or more need 1 toilet seat and 1 urinal per 40 workers. 200 or more need 1 toilet seat and 1 urinal per 50 workers. The table applies to each jobsite.

Is there an exception for mobile crews?

OSHA's construction rule says the toilet requirement does not apply to mobile crews that have transportation readily available to nearby toilet facilities. A road crew moving several miles a day can rely on that exception. A crew parked at one house for a week usually cannot, because the work is not mobile.

What are the handwashing rules on a jobsite?

OSHA 29 CFR 1926.51(f) requires washing facilities where workers apply paints, coatings, herbicides or insecticides, or handle other harmful contaminants. The facilities must be near the work and kept sanitary, with water, soap and towels. A two-basin hand wash station meets that need.

What do farms and field crews need?

OSHA 29 CFR 1928.110 covers agricultural field work with 11 or more employees: 1 toilet and 1 handwashing facility for every 20 employees, located within a quarter-mile walk of each worker. Field crews of 10 or fewer, or work under 3 hours a day, may fall outside the rule.

Is the OSHA minimum enough?

The OSHA minimum is a legal floor, not a comfort target. One standard unit holds about 200 uses between services. A crew of 20 using one unit for a full week will fill it by midweek. Alan Rental Works recommends 1 unit per 10 workers with weekly service, or twice-weekly service for bigger crews.

Does Pennsylvania add its own jobsite toilet rules?

Pennsylvania private-sector construction follows federal OSHA. Some public projects, school districts and union agreements add their own sanitation specs, such as a hand wash station per site or service twice a week. Check your contract documents and the project's safety plan.

Does OSHA require a separate toilet for women?

Table D-1 counts toilets by total workers. Many GCs add a separate unit or a lock for women on larger crews; ask your safety officer.

Does OSHA say how often a jobsite toilet must be cleaned?

OSHA requires facilities to be kept sanitary. Weekly service is the industry norm; heavy-use sites need more.

Can workers use a nearby gas station instead?

Only mobile crews with ready transportation can rely on nearby facilities. A fixed jobsite needs its own toilets.

Do I need a toilet for a one-day job?

If the crew stays at one site all day, plan a toilet. A short single-day rental costs the event rate.

Who has to provide the jobsite toilet?

The employer is responsible. On many residential jobs the homeowner rents it at the contractor's request.

Does a hand wash station count as a washing facility?

A two-basin station with water, soap and towels serves as a washing facility near the work area.
